1) Delivery – All orders are subject to acceptance by Myriad Industries. Shipping and handling fees, special packaging materials, freight, fuel surcharges, and hazardous material fees, as applicable, shall be added to the invoice.
2) Damaged Goods – Please inspect your delivery upon receipt – note any external damage to any boxes with the driver and mark the delivery receipt with the information. Should you find any damage to the contents of your shipment, please contact Myriad Industries within five (5) business days. Please retain all boxes and packaging materials for our inspection. Myriad Industries reserves the right to repair or replace any damaged product, or issue credit, at our sole discretion.
3) Product Return Policy – All returned must be authorized by Myriad Industries to ensure proper credit. Each product return must include the following information:
a) Customer Name and Address
b) Purchase Order Number
c) Myriad Industries Shipping Order Number
d) Date of Invoice
e) Catalog Number of each returned item and the quantity returned
f) Myriad Industries Return Goods Authorization Number
g) Reason for Return
*Products not authorized for return include but are not limited to:
a) Products not in resalable condition - including proper original packaging
b) Chemicals, reagents, diagnostics, and ALL STERILE products, unless they do not meet product specifications
c) Used equipment, or equipment without original packaging, labels, and operating manuals
d) Refrigerated or perishable products
e) Special order or custom products
f) Products with an expired shelf life or an expiration date too short for resale
g) Discontinued products
*The return of any hazardous materials must be packed and labeled in compliance with appropriate DOT regulations.
4) Liability - Myriad Industries sole liability for defective or non-conforming products shall be for Myriad Industries to repair, replace, or issue full or partial credit for the material. Under no circumstances shall Myriad Industries have any liability for exemplary, punitive, incidental, indirect, special, or consequential damages. The total liability or Myriad Industries for damages relating to products sold under this agreement shall be limited to the price paid for such products.
5) Limitations – The Myriad Industries Shipping and Returns agreement constitutes the entire agreement between Myriad Industries and the Customer. Terms and Conditions as they relate to customer purchase orders and/or policies are not applicable to this agreement, and shall not be honored by Myriad Industries. |
