1.) Acceptance - All sales are subject to the terms & conditions contained herein, or standard terms & conditions established by Myriad Industries. Any terms & conditions set forth by the customer in an order acknowledgement or purchase order that are inconsistent with these policies are expressly rejected. No variation of the terms & conditions will be binding on Myriad Industries unless agreed in writing and signed by an officer of Myriad Industries.
2.) Specifications - All product specifications are subject to change without prior notice.
3.) Pricing - All prices shown are subject to change without prior notice.
4.) Payment Terms - Standard payment terms, upon approved credit, are net 30 days from date of invoice. All invoices are payable in U.S. dollars. Delinquent accounts are subject to a 1½% service charge per month (or maximum amount permitted by law). Credit card payments made by the customer are subject to a 2.5% processing fee. Customer may be charged bank fees for payments made by Electronic Funds Transfer (EFT) or electronic transfers directly to the account of Myriad Industries. Customer agrees to supply sufficient credit information to Myriad Industries to establish credit worthiness. Credit shall be extended to customers on an individual basis, at the sole discretion of Myriad Industries, and may be revoked at any time without any cause.
5.) Sales Tax - All applicable sales tax (local, state, federal) shall be added to the invoice.
6.) Limitation of Liability - The total liability of Myriad Industries and its agents for any damages relating to the products sold under this agreement shall be limited to the price paid for such products. Myriad Industries shall have no liability for indirect or consequential damages including, but not limited to, loss of profit, use, or goodwill.
7.) Applicable Law - This agreement is made and shall be construed according to the laws of the state of California, or United States federal law, if applicable. |
